Terms of use
Version of 28 October 2026.
1. Who we are, what this is
fahrstark.ch (the “Service”) is a web application for rehearsing the Swiss practical driving examination on a surveyed examination ground. It is published by Aleksei Rakhimov, a private individual domiciled at c/o JL Consulting Group GmbH#1660, Zürcherstrasse 84, 8852 Altendorf, Switzerland (the “Provider”), e-mail stark@fahrstark.ch. The Provider is not a company, not a driving school and not an authority.
These terms govern every use of the Service. By opening the Service you accept them; if you do not, do not use it.
2. What the Service is not
- It is not affiliated with, endorsed by or supported by any cantonal road-traffic office (SAN, Strassenverkehrsamt, OCV, or any other), the Association of Road Traffic Authorities (asa) or the Federal Roads Office (OFROU/ASTRA).
- It does not teach driving and does not replace lessons with a licensed driving instructor, the official first-aid, theory and awareness courses, or any legal requirement for obtaining a licence.
- It issues no licence, certificate or attestation and gives no guarantee of passing any examination. Examination results depend on the candidate, the examiner and the conditions of the day.
- The routes and situations are not the official examination routes, which are not published and change with the examiner. They are the same public ground, driven the way an examiner may drive it.
- What the Service shows is a simplified model of the road, the vehicle and the manoeuvres. Real traffic requires your own judgement at every moment; nothing in the Service replaces it.
3. Content, accuracy and the law
The Service cites articles of Swiss federal road-traffic law (LCR/SVG 741.01, OCR/VRV 741.11, OSR/SSV 741.21 and related texts). The authoritative text is the one published by the Federal Chancellery at fedlex.admin.ch; in case of any difference, the federal text prevails. Laws, signs, markings, speed limits and the ground itself change. The Provider verifies the content with care but does not warrant that it is complete, current, free of errors or applicable to your case. If you find an error, please write to stark@fahrstark.ch — we are grateful for it, and it is how the Service improves. The Provider gives no undertaking as to when or whether a particular correction is made. This is preparation, not legal advice. The texts here are written by the Provider from the federal sources; wherever anything turns on your own case, the federal text and the cantonal road-traffic office decide, not this Service.
Photographs, maps and aerial imagery come from third parties (swisstopo, OpenStreetMap contributors, KartaView and Mapillary photographers) under their own licences, credited where shown. Their accuracy and currency are theirs, not the Provider’s.
4. Access
- Use requires an e-mail address and the short form at the door, to which a personal sign-in link is sent. There is no access without an account.
- The Service is free for the learner, and stays free. There is no price, no plan, no trial period and no payment of any kind. The whole route is open from the first minute.
- What opens the access is your acceptance of the condition of use. Before the form, the Service shows, in the language you are reading, what it collects and to whom it passes it; access is given only after you accept that. The wording you were shown at that moment, with its version, is recorded with your account.
- The condition, in the words you are shown: “What we pass on. To the partner driving school in your region: your contact details and how you drove the route. Nothing else, and to nobody else.”
- Access is personal, tied to your e-mail address, and may be used on your own devices. It may not be shared, resold or used to train other products.
5. Availability, changes, ending the Service
The Service is provided “as is” and “as available”. The Provider does not promise uninterrupted or error-free operation. The Service may be slow, unavailable, or fail — through hosting outages, network faults, browser changes, maintenance, attacks, or errors in the Service itself — and the Provider accepts no liability for the consequences of such unavailability.
The Provider may change, add or remove content, features and routes at any time. The Provider may discontinue the Service with 30 days’ notice on the site.
6. Your obligations
You use the Service at your own risk and only for your personal preparation. You will not copy, scrape, reverse-engineer, redistribute or publicly perform the Service's own material — its situations, questions, route models, texts and code — nor use it to build a competing product, nor attempt to bypass the access control. Access may be withdrawn in case of abuse.
A contractual penalty. If you break the paragraph above through your own fault, you owe the Provider a penalty of CHF 500 for each breach; and for each case of systematic extraction of the Service's own material, of its resale, or of its use to build a competing product, CHF 25,000. The penalty is owed in addition to stopping the breach and removing what was taken, and it is owed even if the Provider has suffered no loss. Any loss above the penalty remains claimable.
This does not apply to the third-party photographs shown in the Service. They are published by their authors under CC BY-SA 4.0, and you may use them under that licence whatever this section says. Nothing here restricts a right their licence gives you.
7. Limitation of liability
To the fullest extent permitted by Swiss law (in particular art. 100 and 101 CO), the Provider excludes all liability for slight negligence and for indirect or consequential loss — including a failed examination, its fees, lessons, travel, lost time or income, damage to a vehicle, or any accident or fine on the road. Liability for gross negligence and intent, and for damage to life and health, remains as the law provides. Where liability cannot be excluded, it is limited to the amount you paid to the Provider in the twelve months before the event.
8. Intellectual property
The Service's own material — its code, texts, situations, clips, route models, questions, screens and drawings — is the Provider's work and is protected by copyright. Third-party maps, imagery and photographs remain their authors', under the licences stated on the site; nothing here restricts a right those licences give you. Federal law texts are free of copyright. The names fahrstark.ch and Torque F are used by the Provider as the names of this Service.
9. Data protection
How personal data is handled is described in the Privacy notice, which forms part of these terms.
10. Applicable law and forum
Swiss law applies, to the exclusion of conflict-of-law rules and the CISG. The courts at the Provider’s domicile in Switzerland have jurisdiction, subject to any mandatory forum for consumers. If a clause is invalid, the rest stands.
11. Changes to these terms
The current version is the one published here, with its date. Material changes are announced on the site; continued use after that is acceptance.
